The Commodity Futures Trading Commission is seeking public input on how to regulate retail commodity transactions involving crypto assets and whether to create a registration category tailored to crypto markets. Its Oct. 5 announcement opens a discussion about both transaction safeguards and market structure, without adopting a new framework.

The agency’s announcement of an advance notice of proposed rulemaking, or ANPRM, concerns Section 2(c)(2)(D) of the Commodity Exchange Act. The CFTC says comments will inform possible future action, including a rulemaking. This is an advance notice requesting information and views, rather than a proposed rule or a final rule.

Two questions within one notice

The first part concerns retail commodity transactions involving crypto assets, which the agency calls CTXs. The CFTC says it wants input on preventing abusive practices and providing crypto-specific compliance context informed by its experience.

That framing puts the treatment of transactions at the center of the inquiry: what safeguards and compliance guidance should apply in the crypto setting? The announcement identifies those goals but does not establish a new set of requirements for market participants.

The second part asks about potentially creating a purpose-built “crypto asset market” subcategory of designated contract market registration. The agency is soliciting views on that idea; it has not established the category.

Read together, the two topics show the scope of the discussion. The CFTC is considering both how crypto retail transactions should be addressed and how a specialized market might fit within registration. The announcement does not resolve either question or commit the agency to a particular outcome.

Federal Register publication sets a Dec. 14 deadline

The official Federal Register notice was published Oct. 13, 2026, as document 2026-20888 at 91 FR 64811–64840. It identifies RIN 3038-AF80 and sets Dec. 14, 2026, as the comment deadline. The Federal Register comment link points to CFTC-2026-2179-0001 on Regulations.gov; the docket page’s comment counts and activity were not independently reviewed for this update.

The full notice develops two preliminary strands. Regulation CTX addresses the CFTC’s preliminary interpretation of certain crypto retail commodity transactions under Section 2(c)(2)(D), including questions about an “offer” and “actual delivery.” Regulation CAM contemplates a tailored subcategory of designated contract market registration for exchanges dealing in CTXs. Its questions also cover futures commission merchants, clearing and derivatives clearing organizations, leverage and margin, integration, and exemptions.

The notice’s action is an advanced notice of proposed rulemaking. It does not adopt a final rule, establish binding new requirements or settle a compliance start date. Responses will inform whether and how the CFTC proceeds with rulemaking. The next material development would be an agency action explaining how it uses those comments or advances a framework beyond this preliminary stage.
